Did your pool builder give you a neighbor letter for access? This letter is an agreement letter for the protection of all parties and usually insures your neighbor that his yard will be returned to like condition as prior to construction.

Yes but my neighbor won't let me present it to him he wants nothing to do with this?

Do you have pictures of either side for access? With a Bobcat dig you should be able to get by with 5' to 6' ? Sometimes it means moving existing landscape or creative thinking. I have never not been able to dig a pool.

(I would also reconsider where to put the pump and noisy stuff. They TOTALLY go by that guy's fence!!!)

But seriously, good luck. Hope your builder is creative enough to get your hole dug somehow!

Fori has a point! He didn't hold up his end of the deal, so why should you? A good neighbor is a good thing. A bad one makes every day horrible. If you have room on the other side put it there just to keep the peace. Not your fault if he is a jerk, but you don't have to stoop to that level. I've lived next to good and bad neighbors over the years.

In fact, we now have Bob with two o's. We call him that, so much, it may come out some day. Anyway, he's a single, crabby old man who is stuck in his ways. His main beef is if someone has a party and plays music into the night, or accidentally parks partially over his driveway. Sigh. I've had worse. We all get along because we roll our eyes and say nothing. The party will be next year, and he'll be invited. Band will stop at 10 PM.

I hope you let us know if you are able to get that Bobcat back there. Wheelbarrows suck, but sometimes you just have to do what is necessary to get the job done.

In certain areas their are often local laws that allow for 'reasonable access'. Essentially it gives you the right to impede on your neighbors property to gain access to your property for 'reasonable' work as long as you restore their property 'as is or better'. This of course can vary a lot from area to area but where I live it's a city by-law.

I've only seen used once in my 20 years as a pool builder. In fact they actually didn't 'use' the by-law as so much as show their neighbor the by-law and come to an understanding.
